A ruling of the Supreme Court on an episode of invasion of privacy.
The woman had started receiving numerous phone calls from unknown that bothered.
The ruling of the Supreme Court came after the pronouncement of the Court of Rome, in November 2005 had sentenced the man to the crime punished by law for the protection of privacy and harassment, imposing the defendant eight months' imprisonment, suspended with probation, and a compensation of 10 000 €.
The Rome Court had emphasized that the users of the web, after reading the offers contained in the e-mail, contacted the girl on the user bad phone and harassment.
The man had approached the Court of Appeal, which last May had reduced the sentence to six months in prison and € 6,000 compensation.
The defense lawyer had appealed the ruling to the Supreme Court, arguing that the young man had placed on the Web one page graphic that contains the mobile number of LM, but not his personal data, since the number of mobile phone users was free from personal references.
The defense added that had been placed only the name of the girl pointed to, without name, and had opened a mailbox with the address of fantasy.
But the Supreme Court declared the application inadmissible, referring to the legislative decree 467 of 2001 in updating the Privacy Act, which defines personal data as "any information concerning a natural person, legal person, entity or association, identified or identifiable, even indirectly, by reference to any other information, including a personal identification number.
